WHEATFIELD: Man pulls gun at party, damages patrol car
Staff Reports The Tonawanda News
A man was charged with kicking out a patrol car window after his neighbors told deputies he pulled out a handgun at a party early Saturday morning.
Neighbors told deputies James Michael Beaver, 27, 6 Lena Drive North, was outside drinking beers with them about 1:13 a.m. when he pulled a semi-automatic handgun out of his waistband.
Beaver allegedly put the clip in the gun and said, “What, are you all afraid of a little gun?”
The neighbors told deputies they were scared and went inside their home.
Deputies arrived shortly afterward, and when they went to talk to Beaver, he was allegedly standing at the top of the stairs, nude and highly intoxicated.
Beaver told deputies to leave his apartment.
He struggled with deputies as they handcuffed him. As he sat on the couch, his roommate found underwear and pants for him to wear, the report said.
According to reports, Beaver kicked and struggled with deputies, so they used pepper spray to subdue him.
Deputies placed Beaver in a patrol car and treated him for the pepper spray exposure, using bottles of water.
While deputies were speaking with witnesses, Beaver turned in the back seat and kicked the driver’s side window several times until it shattered.
Deputies sprayed him with pepper spray a second time, the report said. He was placed in the back of a different patrol car with bars in the windows.
Beaver was charged with second-degree menacing and criminal mischief. He is due today in Wheatfield Town Court.
The handgun, which reportedly had the serial number removed from it, was confiscated by deputies.
The damage to the patrol car window is estimated at $249.
