A Town of Tonawanda man is facing felony charges after leaving a Halloween party in the early Sunday morning and calling police to say there had been a fight.
When Daniel J. Fraley, 25, called City of Tonawanda police from a pay phone at Del-Grove Sunoco on Delaware Street around 2 a.m., he said he wanted to retrieve his glasses and cell phone from the Ilion Street home.
But when police visited the residence they got different story.
Fraley, witnesses said, had been allowed to leave the party on his own but not before waving a stolen Ginsu kitchen knife at a crowd of guests and eventually cutting the homeowner’s brother as he fought Fraley to the ground.
Fraley, of 4715 Sheridan Drive, Apt. 3B, Town of Tonawanda, was arrested and charged with second-degree assault, second-degree menacing, second-degree trespassing, criminal possession of a weapon and petit larceny.
Though it appears the homeowner knew Fraley, who arrived allegedly intoxicated with another male friend, a police narrative states he was banned from the home because of prior comments he had made regarding the homeowner’s young daughter.
When he was asked to leave during the party Saturday evening, the report states an upset Fraley became violent. Fraley’s account did not include that detail.
“He called and said he was just beat up at a house. He claimed he was jumped by three to five people,” City of Tonawanda Police Lt. Fred Foels said.
Those at the home say Fraley was an unwelcome guest who stole the knife from the kitchen and concealed it in his shirt sleeve before lashing out at a group of people. Then the homeowner’s brother claims he tried to knock Fraley to the ground.
“(He) stated that he knew that he had been cut by the knife and just started swinging his fists at Fraley not knowing where the knife had gone, attempting to knock Fraley to the ground,” an officer’s written account of witnesses’ statements reads.
The man sustained only a small cut to his left index finger, according to the report. Then Fraley was apparently allowed to leave with his friend in a waiting car.
Fraley was held for court. The homeowner has since applied for an order of protection.
