Tonawanda News — North Tonawanda police have arrested a city resident for rape, stemming from a Sept. 1 incident during which a victim reported she was incapacitated.
Lt. Karen Smith said a month-long investigation led to a determination that Evan J. Thompson, 24, 163 Ninth Ave., took advantage of a woman who was “physically helpless,” meaning the two allegedly engaged in sexual relations while the victim was “passed out or intoxicated.”
Thompson turned himself in to police on Saturday along with his attorney and was charged with first-degree rape and first-degree sexual abuse. He was arraigned in North Tonawanda City Court on Saturday, and is being held on $5,000 bail in Niagara County Jail.
Police say Thompson does not have a history of arrests.
“It was a one-time incident,” Smith said, adding that Thompson lives in Oswego but commutes to North Tonawanda on weekends, making contact difficult.
“He’s someone who lived outside the area.”
Thompson is due in North Tonawanda City Court on Oct. 23.
