Gabrys gets released
Pamela J. Gabrys, the City of Tonawanda woman accused of letting her live-in boyfriend spend a month on the floor in his own waste, was released on her own recognizance Tuesday by City Court Judge Joseph J. Cassata.
Gabrys’ attorney, Alan Donatelli, requested that the $50,000 bail on his client be dropped while the Erie County district attorney’s office investigates whether to upgrade Gabrys’ misdemeanor charge to a felony.
Donatelli argued Gabrys be released in the meantime because she holds a steady job. Gabrys, 52, is due back in court Tuesday for further proceedings. City Building Inspector Kevin Rank is working with the Erie County Health Department to ensure that Gabrys makes significant progress in cleaning up her home at 182 Canton St.
When police were called there earlier this month, they found Gabrys’ 54-year-old boyfriend lying on the bedroom floor. He had been there approximately one month since taking a fall.
Police described the home as being in deplorable condition inside with empty beer cans, animal waste and trash scattered about the residence. The victim is still being treated at Erie County Medical Center.
City of Tonawanda
CHARGED: Robert S. Magaris, 23, 1080 Military Road, Kenmore, was arrested Tuesday morning on a warrant for an original offense of harassment Sept. 23, 2007. Magaris is being held in lieu of $5,000 bail.
North Tonawanda
CHARGED: Michael W. Bair, 17, 4674 Meyer Road, North Tonawanda, was arrested late Monday following an investigation. He was charged with third-degree burglary, third-degree grand larceny and fifth-degree conspiracy. Bair is being held without bail. No fingerprints were taken immediately following his arrest.
CHARGED: Aaron N. Wixnler, 18, 240 Witmer Road, North Tonawanda was arrested just before midnight Monday and charged with third-degree burglary, third-degree grand larceny and fifth-degree conspiracy. He is being held without bail.
CHARGED: Travis A. Downey, 17, 195 Christiana St., North Tonawanda was arrested early Tuesday morning and charged with second-degree assault, first-degree aggravated criminal contempt, first-degree criminal contempt, fourth-degree criminal mischief and second-degree menacing. Police were granted a warrant for his arrest.
CHARGED: Scott M. Radowsky, 39, and Matthew R. Huttenair, 16, both of 7 E. Oliver St., North Tonawanda were arrested Tuesday. Radowsky was charged with three counts of endangering the welfare of a child. He is being held in lieu of $500 bail. Huttenair was charged with one count of unlawful possession of marijuana. He was released on his own recognizance.
Town of Tonawanda
CHARGED: Joseph S. Oak was charged with first-degree operation of a motor vehicle while impaired by drugs, crossing the divider on a limited access highway and reckless driving at 3:07 p.m. Monday. Oak was stopped for driving onto the median on Sheridan Drive and found to be lethargic with white residue around his mouth, according to reports. Oak allegedly failed multiple field sobriety tests and blood and urine samples were taken, according to reports. Oak was held for court.
