Man ticketed in fatal accident in Kenmore

Tonawanda News — Town of Tonawanda police have ticketed Edward Spencer, the 82-year-old man who hit two pedestrians crossing Kenmore Avenue last month.

Spencer, who was driving a 2013 Toyota Corolla, made a left-hand turn out of Budwey’s parking lot at 4:55 p.m. on Dec. 5 before hitting the victims.

Sandra Garner, 52, died at the Erie County Medical Center, while the second victim, while Kevin Nowak, 55, suffered serious injuries. 

Spencer has been issued a ticket for failure to use due care, a vehicle and traffic violation. No criminal charges will be filed, police spokesman Capt. Joseph Carosi said.
